7-02-2021 Any food is misbranded if its labeling is false or misleading, if it is offered for sale under the name of another food, or if it is an imitation of another food for which a definition and standard of identity has been established by regulation. Food or color additives, colored overwraps, lights or other misleading artificial means shall not be used to misrepresent the true appearance, color, or quality of a food.

The label shall contain the following information:
(1) The common name of the food.
(2) A list of ingredients in descending order of predominance by weight.
(3) The weight, count, or volume.
(4) The name and place of business of the manufacturer, packer, or distributor.
Nutrition labeling may also be required, and must be included when it is available from the manufacturer.

Food facility's or manufacturer's dating information, such as date codes or "use by" statements on packaging may not be concealed or altered.
PREPACKAGED FOOD (FLAVORED NUTS AND SEEDS, DRIED FRUIT, ETC.) PACKAGES FOR RETAIL SALE: There were many packages that were missing labels on the sales floor. Employee was notified and stated the packages just got delivered and she will put the labels on the packages. Discontinue this practice. All packages must be labeled PRIOR to being put for sale on the sales floor. 0169 FARM STAND
7-02-2021 A person proposing to build or remodel a food facility shall submit plans for approval before starting any new construction or remodeling of any facility for use as a retail food facility. (114380, 114381) 1.00 A person proposing to build or remodel a food facility shall submit complete, easily readable plans drawn to scale and specifications to the Division of Environmental Health and obtain approval prior to starting any project. Facility has exceeded the 50 square feet allowable space for storage and display of prepackaged, non-potentially hazardous food products that are not grown or produced by the operator (beef jerky, candy, popcorn, jams/jellies/marmalade, flavored dried/roasted nuts/fruits/seeds, flavored syrups, hot sauces, jarred olives/okra/garlic/beans/salt-seasoning, etc.) in close proximity to the farm stand as stated below. Reduce the footprint to a maximum total of 50 square feet of storage and sales area. Follow-up in 30 days.

*Jars of honey shall be produced by the operator to not be counted in the 50 square feet.

*Mangos, pineapples, and other whole produce can only be sold at the farm stand if they are grown or produced by the operator in close proximity to the farm stand.

(c) Food sales from farm stands shall be limited to the following:
(1) Whole produce and shell eggs as described in paragraph (6) of subdivision (c) of Section 113789.
(2) Nonpotentially hazardous prepackaged food products from an approved source that were grown or produced in close proximity to the farm stand and in a manner consistent with the intent of Chapter 10.5 (commencing with Section 47000) of Division 17 of the Food and Agricultural Code.
(3) Any nonpotentially hazardous prepackaged food products, including bottled water and soft drinks, from an approved source that has not been grown or produced in close proximity to the farm stand shall be limited to a 50-square-foot storage and sales area.
