Toilet tissue shall be provided in a permanently installed dispenser at each toilet. The number of toilet facilities shall be in accordance with local building and plumbing ordinances. Toilet facilities shall be provided for patrons: in establishments with more than 20,000 sq ft.; establishments offering on-site food consumption. Customer restrooms are required for food facilities of more than 20,000 square feet if they were constructed after July 1 1984, and also applies to facilities of any size that were constructed after January 1, 2004 where there is onsite consumption of food. A "take-out only" food facility, with no seating indoors or outdoors, may not be required to provide customer restrooms. Check with the Division of Environmental Health and with the appropriate Planning Department before removing or restricting access to customer restrooms.

REPEAT: Observed the non functioning refrigeration unit to the left of the under hood fryers, below the fryer drain pan area is still present. Remove or repair the non functioning unit. Failure to keep the premises of each food facility free of items that are unnecessary to the operation or maintenance of the facility, such as equipment that is not functional or is no longer used. 5-21-2019 A food facility shall not be open for business without a valid permit. (114067(b) & (c), 114365, 114365.5, 114381, 114381.1 114381.2, 114387, 114390) 2.00 Pay the required annual permit fees. Renewal fees for existing permits for each calendar year are assessed and due in January of each year.

For purposes of enforcement, an enforcement officer may, during the facility's hours of operation and other reasonable times, enter, inspect, issue citations to, and secure any sample, photographs, or other evidence from a food facility or any facility suspected of being a food facility, or a vehicle transporting food to or from a retail food facility, when the vehicle is stationary at an agricultural inspection station, a border crossing, or at any food facility under the jurisdiction of the enforcement agency, or upon the request of an incident commander. It is a violation for any person to refuse to permit entry or inspection, or interfere with the performance of the duties of an enforcement officer, including making verbal or physical threats or sexual or discriminatory harassment.

Close the facility until a permit is obtained from the Division of Environmental Health.

Observed dirt, grime, and / or dust and food particle buildup on the floor beneath / behind the legs of the customer area soda machine counter legs. Also observed soda splatter residue on shelves in the storage cabinets below the customer area soda machine. Improve cleaning frequency and methods to ensure all equipment is kept in an appropriate state of cleanliness; ensure all equipment surfaces are smooth and easily cleanable, and all potential food contact surfaces are sanitized on a regular basis. 0102 FOOD ESTAB. 5-21-2019 Failure to keep food pure and free from contamination, adulteration and spoilage. Any food is adulterated if it bears or contains any poisonous or deleterious substance that may render it impure or injurious to health. (113967, 113976, 113980, 113988, 113990, 114035, 114254(c), 114254.3) 2.00 Provide adequate protection at all times to keep food pure and free from contamination, adulteration and spoilage. Destroy all contaminated, adulterated and spoiled food. Observed bulk bin of dry, spiral pasta-like product that employee states is used for making cinnamon twists. Small piece of what appears to be tape also found inside bin; small piece roughly 2 inches long by 1/4 inch wide, with what appears to be sugar and cinnamon stuck to the adhesive. Tape and surrounding pasta scooped out and discarded (roughly 1-2 cups of pasta). Remainder of pasta checked, no additional evidence of contamination found. Suspect when bin was marked with bag labeling information is when tape may have accidentally fallen into bin on top of pasta.

Increase caution when labeling food bins in this manner, or alter manner for labeling food bins. Take necessary precautions to prevent similar issues from occurring in the future. All food shall be prepared, stored, displayed, dispensed, placed, transported, sold, and served as to be protected from dirt, vermin, unnecessary handling, droplet contamination, overhead leakage, or other contamination. Destroy all contaminated food.
